Our experienced team, led by partner Neil Summerfield, act for lenders in the recovery of losses incurred by them as a result of negligence and or fraud of the professionals on whom they relied, primarily against surveyors and valuers (for providing over-valuations) and solicitors (for failing to report, whether inadvertently or deliberately, important matters and / or to act in the lender’s best interest).
Our experience in this area goes back to the early 1990s and we are therefore well placed to meet the current problems facing our clients as a result.
We can tailor our service to meet your needs by for example offering you a screening service to assess potential claims. Once instructed to proceed our aim is to recover the maximum potential recovery with the minimum of cost to you. In this regard we are generally able to offer to carry out this work on conditional fee agreements and / or backed by after the event insurance where appropriate so as to minimise the lender’s risk.
We also deal with all the other forms of negligence that our clients may experience and potentially suffer from. For example where the solicitors fail to register the charge or obtain incorrect priority for it. Here we act quickly to resolve the problem and ensure that our client’s interest is best protected in the interim whilst we resolve the issues with the solicitors, the Land Registry or other lenders.
